En 1789, la Révolution française met la liberté à l'ordre du jour. C'est un événement pour la philosophie qui, au siècle des Lumières, a activement participé à la critique du despotisme. C'est aussi un événement philosophique qui délivre à la pensée de nouveaux horizons où les maîtres-mots sont souveraineté politique du peuple et autonomie morale du sujet. De Rousseau, qui fait de la liberté le fondement de toute légitimité, à Hegel pour qui "l'esprit est liberté", en passant par Kant qui (...) consacre le droit inaliénable des peuples à disposer d'eux-mêmes, Michaël Foessel revient sur cette période philosophique si intense. Au cours de ces bouleversements historiques s'élabore une définition de la liberté irréductible au libéralisme. C'est parce que notre époque est incertaine sur le sens de la liberté qu'il vaut la peine d'entendre à nouveau l'exigence d'autonomie portée par la philosophie, de Rousseau à Hegel. (shrink)

Is rabbinic Judaism as a religious philosophy basically critical of the state as a form of human life? Does it contain an ethics of cohabitation with non-Jews? The paper argues that rabbinical Judaism is essentially in favor of states, but against a special Jewish state. The rabbinic principle “Dina de Malkhut Dina” (“The law of the Kingdom is valid and binding”) combined with the universalistic principles of the “noahidic covenant” is the adequate formula for statehood in the era of globalization. Dennoch lassen sich einige allgemeine Aussagen über seine Bedeutung treffen. Gerade Autoren, die im Bereich der Technik- und Wissenschaftsethik aktiv sind, haben sich nachdrücklich um eine Klärung des allgemeinen Verantwortungsbegriffs und seiner verschiedenen Aspekte und Gebrauchsweisen bemüht.

These days, the radicalization of young people is above all viewed as a security risk. Almost all research into this phenomenon has been carried out from a legal, criminological or socio-psychological perspective with a focus on detecting and containing the risks posed by radicalization. In the light of the political developments since September 11, 2001, this is entirely understandable but perhaps not altogether wise. Research and theory development from a pedagogical perspective can also make a significant contribution towards a better (...) understanding of radicalization processes and possibly offer new points of departure for intervention strategies. On the basis of five typical cases, the authors examine the role of educators, social workers and teachers, and the problems they face when dealing with young people with extreme ideals. This article attempts to provide insight into the pedagogical conditions for the development of extreme ideals and suggests starting points for developing effective countermeasures. (shrink)

The book introduces a conception of discourse ethics, an intersubjectivist version of Kantian ethics. Analysing contributions by Jürgen Habermas, Karl-Otto Apel, Wolfgang Kuhlmann, Albrecht Wellmer, Robert Alexy, Klaus Günther, Rainer Forst, Marcel Niquet and others, it reconstructs critical discussions of the justification of the principle of morality (Part I) and the various proposals for its application (Part II). It defends an alternative model of how discourse ethics can provide guidance in non-ideal circumstances and avoid both arbitrariness and rigorism.

The ongoing digital transformation of almost all areas of human action and agency calls for a readjustment of the norms that regulate these practices. For example, the digitisation of communicative practices poses new challenges to their functioning. This paper explains some of these challenges and argues that they cannot be met by a normative framework that focuses mainly on defensive (free speech and property) rights. In the context of mediated digital communication, the application of such a framework may even have (...) paradoxical consequences. Accordingly, this paper argues for a broader system of communicative rights, understood as rights to meaningful participation in well-functioning communicative practices. (shrink)

Against the background of the current debate in Germany, the paper explains and discusses ethical aspects of alternative consent systems for post-mortem organ donation. The focus is on opt-out and prompted choice solutions. The authors explain why libertarian paternalism might favour a prompted choice.

The article examines the extent to which the scope for social design of responsibility regimes is limited by pre-positive boundaries. A distinction is made between purely performative, purely constitutive and normative attributions of responsibility. It is argued that statements about pre-positive responsibilities in a broad area are only possible depending on specific normative-ethical theories. Nevertheless, the article attempts to defend both an outer limit of possible attributions of responsibility and a minimum content of any plausible ethics of responsibility. The outer (...) limit is characterised by the principle 'ultra posse nemo obligatur', the minimum content results from a reflection on the general normative preconditions of each specific attribution of responsibility. This reflection also allows for some tentative considerations regarding the interpretation of processes of transnationalisation. (shrink)

Mitunter werden Konzeptionen der normativen Ethik als VerfahrensethikenVerfahrensethik bzw. als prozeduralistische Ethiken gekennzeichnet. Dadurch wird offenbar angezeigt, dass in diesen Konzeptionen Verfahren bzw. Prozeduren eine besondere Rolle zukommt. Kontraktualistische, kohärentistische und diskurstheoretischeDiskursethik Ansätze werden in diesem Sinne als exemplarisch betrachtet.

Im vorliegenden Beitrag geht es – angesichts der enormen gesellschaftlichen Verbreitung von Quantifizierungstechniken und -imperativen im digitalen Zeitalter – um psychische Bedeutungen des digitalen Messens, Zählens und Vergleichens und um die Faszination für diese Operationen. Mit Blick auf eine sozio- und psychoanalytisch ausgerichtete Hermeneutik der Zahl werden erste Ergebnisse des Forschungsprojekts »Das vermessene Leben« erörtert. Eine der zentralen Fragen ist dabei, wie sich Merkmale digitaler Quantifizierung mit psychischen Dispositionen verbinden, spezifische Bewältigungs- und Abwehrmuster auslösen oder welche Rolle etwa die Externalisierung (...) von Affekt- oder Norm-Regulationen spielt. Während der größte Teil der Bevölkerung die kieferorthopädische Therapie, also die Veränderung der Zahn- bzw. Kieferstellung, als eine Behandlung betrachtet, die vor allem auf eine Verbesserung des Erscheinungsbildes zielt, sehen der kieferorthopädische und zahnärztliche Berufsstand sowie auch private und öffentliche Kostenträger in bestimmten Abweichungen von Zahn- oder Kieferstellungen eine Gefährdung der oralen Gesundheit und der Funktionsfähigkeit des Gebisses. Letztere Auffassung bestimmt das ärztliche Handeln in der Kieferorthopädie und begründet auch die Übernahme zumindest bestimmter Leistungen durch die gesetzlichen Krankenkassen. Anhand aktueller (...) wissenschaftlicher Erkenntnisse lassen sich jedoch in vielen Fällen keine (akuten oder potentiellen) gesundheitlichen oder essentiellen funktionellen Beeinträchtigungen und Risiken abweichender Zahnstellungen nachweisen. Ziel dieses Aufsatzes ist es, diesem Widerspruch nachzugehen. Im Folgenden werden wir aufzeigen, welche Faktoren die Anbieter kieferorthopädischer Leistungen beeinflussen, welches die entscheidenden Gründe und Grundlagen für die Behandlung sind und an welchen Kriterien sich die Leistungsübernahme durch die Krankenkassen orientiert. Dabei wird deutlich werden, dass die formalen Kriterien von Behandlung und Kostenübernahme, die tatsächliche Behandlungs- und Kostenerstattungspraxis, die Erwartungen derjenigen, die Behandlungsleistungen in Anspruch nehmen und der aktuelle Stand der Forschung zu erwartbaren Funktionsbeeinträchtigungen durch Zahnstellungsvariationen nicht zwanglos zu vereinbaren sind. Erforderlich erscheint ein interdisziplinärer normativer Diskurs über die Frage, wie die diagnostizierten Spannungen aufzulösen wären. Als Anregung für einen solchen Diskurs werden wir im Ausblick alternative Lösungsstrategien vorstellen. (shrink)
